The FDCPA and Your Consumer Rights.

If you've been contacted by a debt collector, you probably get overwhelmed and feel unsure of your rights. Fortunately, the Fair Debt Collection Practices Act (FDCPA) is a federal law that provides protections for consumers like you.


The FDCPA regulates the behavior of debt collectors and protects consumers from abusive, deceptive, and unfair debt collection practices. This law applies to third-party debt collectors who are collecting debts on behalf of someone else, but not to original creditors.


Under the FDCPA, debt collectors are prohibited from:


• Contacting you at inconvenient times or places, such as before 8 a.m. or after 9 p.m., or at your workplace if your employer prohibits it.

• Using abusive or harassing language, threatening violence or legal action, or making false statements.

• Disclosing your debt to anyone other than your spouse or attorney.

• Continuing to contact you after you've requested them to stop or if you've hired an attorney.
